2. Terms & Conditions
   I hereby give consent to my child’s use of the Great Neck Park District’s rock-climbing wall. I acknowledge that rock climbing is a hazardous activity and I hereby assume all risks, including serious injury and death, to which my child will be exposed to as a result of his/her participation in this activity.
   
   I understand that both inexperienced and experienced climbers may use this equipment and that serious injury may result from use of this equipment.
   
   I understand that the District’s rock-climbing wall is portable and agree to allow my child to use this equipment at any park or facility where the District elects to set it up. My consent and assumption and agreement here under cover my child’s use at all such parks and facilities of the District.
   
   The Great Neck Park District reserves the right to refuse to allow anyone to use the rock-climbing wall for any reason.
   
   All climbers must wear climbing shoes or sneakers. No bare feet or sandals will be permitted. Climbers may not use the climbing wall while wearing a wet bathing suit or clothing. Climbers may provide and wear their own helmet.
   
   I further agree that my child will obey all rock-climbing wall rules and follow the directions of all Park District employees. Those not obeying the rules will not be allowed to use the rock climbing wall.
   
   Furthermore, because of the obvious dangers and risks involved in rock climbing, and on behalf of myself, my assigned, executors and heirs, I hereby release the Great Neck Park District, its officials, officers, agents and employees and, whether paid or volunteer, from any liability, damages or claims of any nature that arise out of, or relate in any way to my child’s use of, or participation at, the Park District’s rock-climbing wall by me. For the same reasons, I will indemnify the Park District for all liability, damages, claims, costs and expenses, including legal fees, which arise out of, or relate in any way to use of, or participation at, the Park District’s rock-climbing wall, by my child.
   
   By signing this waiver and indemnity form, I understand that if anyone is injured or dies, or if property is damaged, during my child’s participation in this activity, a court of law may find that I have waived my rights to maintain a lawsuit against the Park District for a claim from which I have released the Park District by signing this document.
   
   I have read this document and understand it, and I agree to be bound by its terms.
